New guidelines for Pix amendments

The Supreme Court's decision has sparked a crisis between the Legislative and Judicial branches. Members of Congress, especially those who depend on the amendments to meet their electoral needs, have reacted with indignation, interpreting the decision as an invasion of their jurisdiction.


The National Congress, led by the presidents of the Chamber of Deputies, Arthur Lira, and the Senate, Rodrigo Pacheco, appealed the decision, claiming that it creates legal uncertainty and harms the execution of essential projects for states and municipalities.

After weeks of intense debates and legal proceedings surrounding the Pix amendments, a decision was made in a meeting involving the three branches of government. The President of the Senate, Rodrigo guatemala mobile database Pacheco, announced on August 20 that there was a consensus between the Legislative, Executive and Judiciary branches on the legitimacy of the parliamentary amendments to the federal budget, including the amendments.


In this meeting, which was attended by the 11 ministers of the STF, the president of the Chamber of Deputies, Arthur Lira, the minister of the Civil House, Rui Costa, the attorney general of the Republic, Paulo Gonet, and the attorney general of the Union, Jorge Messias, new parameters were established for the execution of these amendments.


The common understanding was that parliamentary amendments, including Pix amendments, are legitimate democratic instruments, but that they need to be improved to ensure greater transparency, traceability and efficiency in the use of public resources.


The president of the STF, Luís Roberto Barroso, also declared that the Court, the Legislature and the federal government have up to 10 days to present a solution for the lack of transparency and traceability in parliamentary amendments, whether individual, by bench or by committee.


Also at the meeting, it was decided that Pix amendments, now classified as special transfers, will be primarily allocated to the completion of unfinished works, ensuring the effective use of resources in ongoing projects. The other individual amendments will continue to be mandatory, but must follow technical criteria to ensure their viability.

The bench amendments also maintain their mandatory nature, focusing on structural projects in the states and the Federal District, defined by the state benches, to maximize regional impact. The committee amendments, which are not mandatory, will be directed to projects of national or regional interest, defined jointly by the Legislative and Executive branches.
