LGPD – What it is, what has changed and how to adapt

What is LGPD?
First of all, the General Data Protection Law (LGPD) establishes rules on the collection, storage, processing and sharing of personal data, imposing more protection and penalties for non-compliance.

The law was sanctioned in August 2018 and is the Brazilian version of the “GDPR”, integrating Brazil into a group of countries that have their own laws for the protection of personal data.

Legal bases: LGPS hypotheses that authorize the processing of personal data.

With the changes made to the LGPD, the collection and use of personal data must follow the new legal bases imposed by law.

Therefore, it is necessary to obtain consent and legitimate interest from the data owner for the data to be processed. In other words, the person must be informed of what, when and where their data will be used and must provide it freely.

This way, the customer has the option of being impacted and continuing the engagement or not, and gains more control over the use of their data. In addition, they can request the deletion of this data from the company's entire database.
