The Solution: Algorithm Impact Assessment
There is no direct technical fix for fair algorithms. With every AI application where algorithms contribute, there is a chance of side effects. Nobody wants to completely ban AI or algorithms. Fortunately, many problems can be prevented by doing a good impact assessment . Before an algorithm is used in practice, a test must be done. The following must be considered:
How well has the algorithm been tested? Is the test data used representative?
Is there sufficient manual control in the process? Are negative decisions always reviewed?
What data is collected and used for this application? Does the value of the application outweigh the privacy invasion and risks?
Who owns the algorithm and who owns the data? Is this a commercial company with commercial interests? Will this company comply with Dutch law?
The assessment should involve AI researchers, but also domain specialists and preferably also representatives of the group of people on whom the algorithm is applied. The results of the assessment should be public, so that journalists, politicians and citizens also have insight into the results. The assessment will probably have to be updated regularly, because AI algorithms are often provided with new data and settings.
The Algorithm Impact Assessment is unfortunately not mandatory, but fortunately there is something similar. Thanks to the new privacy legislation ( AVG or GDPR) it is already mandatory to look at privacy in many projects. A Data Protection Impact Assessment (DPIA) must be done (see here a template for the content of such an assessment ).
