Sovereignty, the central issue of the dispute

Post by monira khatun »

These understandings are provisional in nature, relating to the creation of a "modus vivendi" for the disputed area, and are aimed at creating the conditions for the resumption of sovereignty negotiations.

The issue of sovereignty, the central issue of the dispute, has not been the subject of talks since the reestablishment of diplomatic relations, due to the United Kingdom's special lead reluctance to include the issue in negotiations despite the international community's numerous calls for a definitive solution to the dispute.

The First Transitory Provision of the 1994 National Constitution states: "The Argentine Nation ratifies its legitimate and imprescriptible sovereignty over the Malvinas Islands, South Georgia Islands and the South Sandwich Islands and the corresponding maritime and insular spaces, as they are an integral part of the national territory. The recovery of these territories and the full exercise of sovereignty, respecting the way of life of their inhabitants and in accordance with the principles of International Law, constitute a permanent and inalienable objective of the Argentine people."
President Kirchner's Government reaffirmed its State policy regarding the Malvinas Question, prioritized the search for the resumption of sovereignty negotiations and continued to comply with the provisional understandings under the sovereignty formula with the United Kingdom regarding practical aspects of the South Atlantic that already exist, expressing its willingness to enter into new ones that are in Argentina's interest and contribute to generating the conditions for the resumption of sovereignty negotiations.
