In order to work effectively and safely, specialists must meet all current legislative requirements to join the SRO. Reasons for refusal to join SRO
Russian legislation specifies three potential reasons for refusal to join a self-regulatory organization. They are listed in Part 5 of Article 55 of the Code. The list is final and cannot be expanded.
A company or individual entrepreneur may be denied admission to an SRO due to:
non-compliance of the applicant with the requirements necessary for issuing a certificate of admission to carry out certain works affecting the safety of capital construction projects and indicated by him in the application;
incomplete set of documents provided for in Part 2 of Article 556 of the Code;
the applicant has a certificate issued by another self-regulatory organization for admission to a certain type or types of work affecting the safety of capital construction projects and specified in the application of the individual entrepreneur or company.
The legislation has developed these standards so that SROs cannot arbitrarily make decisions on the entry of companies into their ranks. Clearly defined grounds for refusal put the interests of applicants above the interests of self-regulatory organizations, since it is the applicants who have the right to choose the organization. Refusal to accept is clearly regulated. Such rules are a kind of assistance in joining the SRO for applicants. Based on Part 8 of Article 55 of the Code, refusal or inaction in admission to a self-regulatory organization can be appealed in arbitration.

It is clear from practice that applicants often do not need to give consent to join self-regulatory organizations, since the submitted documents do not formally comply with the established rules. Usually, either the papers are drawn up incorrectly, or the set is incomplete. All this indicates non-compliance with the requirements for granting admission.
There is also partial compliance with the requirements (not for all declared types of work). The submission by an applicant for joining the SRO of a certificate of admission to perform only part of the work indicated by him is formally correct, but inconvenient, since in this case a re-submission of documents is required.
In this matter, self-regulatory organizations can act in two ways.
First. If the applicant has not submitted the documents in full or has not completed them properly, the SRO may suggest that he withdraw the application for membership in the organization and re-submit it after preparing the entire set of documents and excluding from the application the works for which he does not meet the rules for issuing admission certificates. This approach does not contradict the Code, since the applicant is legally allowed to voluntarily withdraw the application.
The second method. Based on the results of the inspection, the self-regulatory organization informs the applicant about the identified deficiencies in the documents, non-compliance with the requirements and offers to provide the missing papers. In this case, the decision on the applicant's entry into the SRO is suspended for 30 days in accordance with his voluntary application until the missing documentation is submitted. This method is the most optimal for the applicant, since the review period does not start anew, as in the case of the first method, but resumes from the date of suspension - the term of entry into the SRO is not violated.
