What can an artist do in case of illegal use?
If a rights holder sees that a user (by uploading illegal music) or a platform (by having illegal music in the library) is infringing on his rights, he can submit a request to the platform to take the content offline. The platform will assess this request and then take action. This is also called ' Notice and Takedown '. The rights holder can then still choose to hold the user or the platform liable, but in practice it often only ends with taking it offline.
In short: make sure that you have obtained permission from the rights holder for music that c level executive list you do not upload from a library.
On 7 June 2021, a new European copyright directive will come into effect. An important change that this directive brings with it is the liability for platforms (intermediaries) if their users upload illegal content. The Notice and Takedown system will remain more or less the same. But where you can now only hold the user liable, in the new situation you can also contact the platform. In addition, platforms will be obliged to ensure that after taking the illegal content offline, it remains offline, the so-called ' stay down '.
The aim of these changes is to create a vibrant licensing market between platforms and rights holders. This would allow rights holders to benefit from the high revenues generated by the platforms (often through advertising revenue)
